This article addresses some of the fundamental difficulties with protecting patents in Africa. Outdated laws, their lack of enforceability or the utilisation of the public interest for politic reasons, are of the major problems. Considering this scenario, some practical solutions are presented in order to ease these problems and taking into account that the absence of any protection is not an option.
